Creative Services Terms

How brand, design, content and creative production engagements with CAQA Creative work.

1. About these terms

These Website Terms apply when you access or use CAQA Creative. By using this website, you agree to use it lawfully, respectfully and only for its intended purpose. The information on this website is provided for general information and service-description purposes. Specific terms may also apply to purchases, subscriptions, events, courses, memberships, software, resources, consulting engagements or directory listings. These Creative Services Terms are those specific terms for the brand, design, content and creative production services described on this website. They should be read together with our Privacy Policy, Revision Terms, Cancellation Policy and Intellectual Property and Copyright policy.

2. Who we are and who this website serves

CAQA Creative is the brand, design and creative production arm of CAQA Groups and a Career Calling International initiative, operated under Career Calling International Pty Ltd (ABN 53 162 651 238). This website serves creative practitioners across performing arts, creative writing, fashion design, visual arts, music production and the wider creative industries, together with education providers, businesses and community organisations that need brand, design, content, visual identity and creative production support.

3. Services offered through this website

Through this website you can explore our creative service lines, view the CAQA Creative showcase, read about our studio, review indicative plans and pricing, request an appointment and make enquiries. The services described include creative direction and brand styling, design for print and digital media, copy and content development, editing and manuscript critique, exhibition and showcase features, music production support, promotion and campaign consultation, and custom creative packages tailored to a project, a launch or a growing creative business.

4. How engagements are formed

Client work is performed under an agreed proposal, quote, service agreement, retainer or written scope. The scope will identify the deliverables, assumptions, client responsibilities, fees, payment terms, timelines and review process. Clients are responsible for providing accurate, complete and timely information. Work outside the agreed scope may require a variation, additional fee or revised timeline. Nothing on this website is a binding offer: an engagement begins only when a written scope, plan or booking is confirmed by both parties.

5. Fees and payments

Indicative rates and plan inclusions, including our hourly rate and tiered plans, are published on our pricing page as a guide only and may be updated from time to time. No payments are taken through this website: there is no online checkout, cart or payment gateway on this site. Once a plan or scope is confirmed, fees are invoiced by Career Calling International Pty Ltd and are payable by the due date shown on the invoice. Custom packages are priced on scope and confirmed in writing before work begins.

6. Client obligations

Clients agree to supply the content, artwork, briefs, credentials and approvals reasonably required for the engagement, to respond to feedback and approval requests within the timeframes stated in the scope, and to nominate a single point of contact for consolidated feedback. Clients warrant that any material they supply for use in a deliverable is owned by them or properly licensed, and does not infringe the rights of any third party. Delays in supplying material or feedback may extend timelines and, where significant, may attract a variation.

7. Revisions

Each scope includes a stated number of revision rounds. What counts as a revision, how feedback must be provided and how major changes are charged are set out in our Revision Terms.

8. Cancellations and refunds

Appointments, project engagements and plans may be cancelled in accordance with our Cancellation Policy, which also explains how the Australian Consumer Law applies to our services.

9. Intellectual property

Ownership of commissioned work, CAQA pre-existing intellectual property, stock assets, fonts and editable files are dealt with in our Intellectual Property and Copyright policy and in the individual scope.

10. Limits of advice

Creative, brand and content information published on this website is general in nature and is not tailored professional advice. Advice given during an engagement is based on the brief and the information supplied by the client. CAQA Creative does not guarantee commercial results, audience growth, sales, publication, exhibition placement, chart performance, funding or award outcomes. Guidance about names, logos and branding is creative in nature and is not legal advice: trade mark availability, registration and clearance should be confirmed with a qualified trade marks attorney before committing to a new identity.

11. Acceptable use of this website

You must not misuse this website, interfere with its operation, attempt unauthorised access, scrape or republish its content without permission, or submit false, misleading, unlawful or infringing material through our forms. We may withdraw or amend website content at any time without notice.

12. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
