Intellectual Property and Copyright

Ownership, licensing and copyright for website content and commissioned creative work.

1. Purpose

This Intellectual Property and Copyright policy explains how CAQA Creative, part of CAQA Groups and Career Calling International Pty Ltd (ABN 53 162 651 238), manages copyright and other intellectual property rights in two areas: the content published on this website, and the creative work we produce for clients through branding, design, content and creative production engagements.

2. Ownership of website content

Unless otherwise indicated, the content of this website - including text, page layouts, graphics, logos, icons, photography, showcase imagery and downloadable materials - is owned by or licensed to Career Calling International Pty Ltd and is protected by the Copyright Act 1968 (Cth) and international copyright conventions. The CAQA Creative name and logo, and the names and logos of other CAQA Groups brands, must not be used without our written permission. Work displayed in our showcase may also remain the property of the featured artist, designer, writer or client, and is displayed with permission.

3. Permitted quoting

You may quote brief excerpts of text from this website for the purposes of review, commentary, criticism, research, study or news reporting, provided the excerpt is reproduced accurately, is attributed to CAQA Creative and, where published online, includes a link back to the page it came from. You may also share links to our pages freely. You must not reproduce whole pages or substantial portions of this website, use our content for commercial purposes, or present our content as your own, without prior written permission.

4. Permission requests

Requests to reproduce, republish or adapt any content from this website beyond the permitted quoting described above should be sent to info@caqa.com.au or lodged through our contact page. Please describe the material you wish to use, the format and audience, and the duration of the proposed use. We aim to respond to permission requests within ten business days.

5. Ownership of commissioned creative work

For client engagements, ownership of the final deliverables identified in the written scope transfers to the client when the final invoice for the engagement has been paid in full. Until that time, all work in progress and delivered drafts remain the property of Career Calling International Pty Ltd and are supplied for review purposes only. Concepts, drafts and design directions that are presented but not selected as the final deliverable remain our property and may be reused or adapted for other purposes.

6. CAQA pre-existing intellectual property

Our working methods, creative processes, templates, frameworks, grids, style systems, internal libraries and production tools existed before, or are developed independently of, any single engagement. This pre-existing intellectual property is not assigned to the client. Where it is embedded in a deliverable, the client receives a non-exclusive, perpetual licence to use it as part of that deliverable, but may not extract it, resell it or supply it to third parties as a standalone asset.

7. Stock assets and fonts

Deliverables may incorporate stock photography, illustration, video, music or other third-party assets, as well as commercial typefaces. These assets are licensed, not owned, and their use is governed by the terms of the relevant third-party licence. Where practicable we license stock assets in the client's name; where a licence is held by us it may not be transferable, and continued or expanded use may require the client to purchase their own licence. Fonts used in a deliverable are frequently subject to per-user or per-organisation licensing, and clients who wish to edit files or extend the brand in-house may need to purchase their own font licences. The scope will identify significant third-party assets and any licence costs.

8. Editable and source files

Unless the written scope expressly includes editable or source files (such as layered design files, working documents or project files), deliverables are supplied in final formats appropriate to their use, such as print-ready PDF, packaged image formats or published copy. Editable files can be included in a scope or purchased separately and, where supplied, are provided as-is, with any embedded third-party assets remaining subject to clause 7.

9. Showcase and portfolio use

We may display completed client work in the CAQA Creative showcase, our portfolio, case studies and promotional material, with appropriate credit. Clients who require confidentiality or wish to opt out can note this in the scope or advise us in writing at any time.

10. Client-supplied material

Material supplied by clients for use in an engagement remains the property of the client or its licensors. The client grants us a licence to use, reproduce and adapt that material to the extent necessary to deliver the engagement, and warrants that our use of it will not infringe any third-party rights.

11. Infringement concerns

If you believe content on this website infringes your copyright or other rights, contact us at info@caqa.com.au with details of the material and the basis of your concern. We will review the matter promptly and, where appropriate, remove or amend the material while it is investigated.
